Fresh Fire Terms of Service

1. Acceptance of Terms

Welcome to Fresh Fire. These Terms of Service (“Terms”) govern your access to and use of the Fresh Fire mobile application, website(s), and related services (collectively, the “Service”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. Changes to Terms

We may modify these Terms at any time. Changes take effect immediately upon posting the revised Terms. Your continued use of the Service after changes are posted constitutes acceptance. Please review the Terms regularly.

3. Privacy Policy

Your use of the Service is also subject to our Privacy Policy, which is incorporated by reference and explains how we collect, use, disclose, and protect information, including information related to student users.

4. Eligibility

  • You must be at least 13 years old to create your own account and use the Service independently.
  • If you are under 18, you must have permission from a parent or legal guardian, and they must agree to these Terms on your behalf.
  • If you are under 13, only your parent or legal guardian may create and manage your account. By creating the account and agreeing to these Terms, the parent or legal guardian provides consent to these Terms and the Privacy Policy on the child’s behalf.

By using the Service, you represent and warrant that you meet the applicable eligibility requirements and that you will not use the Service for any unlawful or prohibited purpose.

5. User Accounts

To use certain features, you may need to create an account. You are responsible for:

  • Providing accurate and complete information during registration;
  • Maintaining the security of your credentials;
  • All activities that occur under your account; and
  • Promptly notifying us of any unauthorized use or security breach.

We may suspend or disable any account if, in our opinion, you have failed to comply with these Terms.

6. Children’s Privacy & Parental Consent (COPPA)

6.1 Parent/Guardian-Created Accounts Only

For children under 13 years of age (“Child” or “Student”), only a parent or legal guardian may create and manage the account. By creating the child’s account and agreeing to these Terms and the Privacy Policy, the parent or legal guardian:

  • Confirms they are the child’s parent or legal guardian;
  • Provides verifiable parental consent to the child’s use of the Service;
  • Agrees to these Terms and the Privacy Policy on the child’s behalf; and
  • Authorizes the collection and use of the child’s personal information as described in the Privacy Policy and these Terms.

6.2 Parent Rights

Parents/legal guardians may review the child’s information, request deletion, revoke consent, or terminate the child’s access at any time by contacting support@freshfire.app. Revoking consent may result in suspension or deletion of the child’s account.

6.3 No Direct Sign-Up by Children
Children under 13 must not create accounts or provide personal information directly to Fresh Fire without the involvement and consent of a parent or legal guardian. If we learn a child under 13 has created an account without proper parental involvement, we will delete the account and associated information.

7. User Content

The Service may allow you to post, upload, share, or otherwise make available content, including text, images, audio, or video (“User Content”). You retain ownership of your User Content, but grant Fresh Fire a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, and distribute your User Content solely to operate, improve, and provide the Service.

You are solely responsible for your User Content and represent that you have all rights necessary to grant this license. You agree not to post User Content that:

  • Violates any laws or regulations;
  • Infringes third-party rights;
  • Is harmful, offensive, or inappropriate;
  • Interferes with the proper functioning or security of the Service; or
  • Conflicts with Christian values and principles.

We may remove any User Content at our discretion without notice. Parents/guardians are responsible for Student Users’ conduct and content.

8. Prohibited Conduct

You agree not to:

  • Use the Service for any illegal or unauthorized purpose;
  • Interfere with, disrupt, or attempt to gain unauthorized access to the Service or related systems;
  • Circumvent security or access controls;
  • Impersonate any person or entity;
  • Harass, bully, or intimidate others;
  • Collect or harvest information about users without consent; or
  • Use the Service in a manner that could disable, overburden, or impair it.

9. Intellectual Property Rights

The Service and all content, features, and functionality (including software, designs, text, graphics, logos, trademarks, and the compilation thereof) are owned by Fresh Fire or its licensors and are protected by intellectual property laws. Except as expressly permitted by these Terms, you may not use, reproduce, distribute, publicly display, or create derivative works of any portion of the Service without our prior written permission.

10. Anti-Copying, Anti-Scraping & Competitive Use Restrictions

To protect Fresh Fire’s mission, community, and intellectual property, you (including individuals, developers, and businesses) agree that you will not, without our prior written consent:

  • Copy, scrape, crawl, harvest, index, or otherwise extract data, content, or structure from the Service by any automated or manual means (including bots, crawlers, spiders, or bulk downloading tools);
  • Reverse engineer, decompile, disassemble, or otherwise attempt to derive source code, algorithms, models, or underlying non-public methodologies, except where prohibited restrictions are unenforceable by law;
  • Replicate, clone, reproduce, or create derivative works of the Service, its look-and-feel, workflows, data models, or features for the purpose of building, training, or improving a competing product or service;
  • Benchmark, publish, or disclose performance or feature comparisons for competitive purposes;
  • Use the Service or any data from it to train models or datasets for commercial use, or to build products that compete with Fresh Fire; or
  • Resell, sublicense, or commercially exploit the Service except as expressly permitted in a separate written agreement with Fresh Fire.

Any permitted access (e.g., via documented APIs) is limited to our then-current documentation, rate limits, and scope, and may be revoked at any time. We may monitor and block activity to protect the Service.

11. Third-Party Services

The Service may contain links to third-party websites or services. We are not responsible for the content or practices of third-party sites or services. Your use of them is at your own risk and subject to their terms and policies.

12. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FRESH FIRE AND ITS AFFILIATES, LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, AND DIRECTORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUE, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

14. Indemnification

You agree to defend, indemnify, and hold harmless Fresh Fire, its affiliates, and their respective officers, directors, employees, contractors, agents, licensors, and suppliers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to: (a) your use of the Service; (b) your violation of these Terms; (c) your User Content; or (d) any violation by a Student User under your supervision or control.

15. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service ceases immediately. Sections intended to survive (including 6, 9–14, and 16–17) will survive termination.

16. Governing Law; Venue

These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles. Any legal action or proceeding arising out of or relating to these Terms or the Service shall be brought exclusively in the state or federal courts located in Texas, and you consent to their jurisdiction and venue.
